Literary Agency Requested Manuscript / Publisher Wants Book

Hi Nathan. I wanted to get your advice. Jeff Herman Literary Agency requested to review my work on November 7, 2011 after querying him. I have not heard back from him and was wondering what the next step is on their part or mine. I also received a contract proposal from a small press publishing company however I have not signed on with them. I feel better getting help in reviewing the contract (he emailed a blank sample per my request for review). Any advice or recommendations would be appreciated. Would also enjoy having the publishing contract reviewed to determine essential revisions/negotiation points.

On #2, the most important thing is that you know what you sign. If you are unfamiliar with publishing contracts and terms I'd recommend engaging with an experienced intellectual property/publishing attorney who might be able to make sure your interests are protected. Otherwise, if there is an advance involved in the contract you may be able to get an agent who would be willing to work with you.

Thanks for the prompt reply. Definitely feel called to consulting with an attorney regarding the contract. Let me know if you can recommend someone or a web resource.

I'm going to add to what Nathan said by providing my own cautionary tale. By all means, if you have an offer from ANYONE (small press, other agent, what have you), absolutely nudge the other agents who have your manuscript. Tell him/her/them you have an offer but that you'd like to know where you stand so you can examine your options and make an informed decision. If you are seriously considering accepting the contract from the small press be sure to let them know that (this is the cautionary part). When I was on submission with one of my novels I received an offer from a small press. I told them other people had my manuscript and asked for time to think before answering. They responded by rescinding their offer. Granted this was not a typical thing to have happen, and in this case it was an absolute blessing, as accepting would have been a horrendous mistake on my part (and I am now happily with a much better publisher, so I'm glad I waited), but the fact remains, they withdrew the offer they'd extended. Be clear with all parties, do your research, and know what you're signing before you sign and you'll be fine. Best of luck to you.

Thanks for the input. I am going to give Jeff Herman Literary Agency a little more time. I expected a prompt reply from them after requesting for my manuscript. I will have the publisher's contract reviewed while waiting for the agency to reply.
